| more than likely the court heard expert medical witnesses on both sides before the judge issued a verdict...the negligence stems from the failure to act as other competent doctors would act in a similar situation (ie performing pathology BEFORE the hysterectomy), but it`s not clear whether the death of the patient was a consequence of the operation/post-op treatment. |
