Attorney for ex-aide in Olmert probe: State using her to get to PM

The attorney for Shula Zaken, Prime Minister Ehud Olmert's former bureau chief who was questioned by police Tuesday for the fourth time in connection with the current criminal investigation against the premier, accused the state of "trying to get to the prime minister by way of Shula Zaken."

In response to reporters' questions, Mika Fettman dismissed suggestions that his client's decision to invoke her right to remain silent was borne out of her guilt.

"Silence can be incriminating evidence if there is enough evidence, but, silence on its own is insignificant," Fettman said, emphasizing that at no time was his client offered to turn state's witness.

"The fact that they're trying to get to Olmert through her has been known to her from day one, in the first investigation," Fettman said. "They're not letting up on her and are continuing even when they don't find evidence because there was no crime."

Fettman told Israel Radio that, to the best of his knowledge, Zaken exercised her right to remain silent during questioning Tuesday at the police's national fraud unit offices in Bat Yam.

"Zaken told investigators from the moment the probe began last Tuesday, that she will not talk about other things until the Tax Authority affair is closed," Fettman said. "They've ruined her life and cast suspicion on her, so after she proved that she didn't commit any crime and the matter remains open - it is unfathomable to begin another investigation."

When asked about the media gag order banning the press from reporting details of the case, Fettman replied: "I think we need to [allow the press] to report the nature of the charges so as to maintain proportion. [The police] should allow publication of parts of the investigation that are tied to the allegations."

Zaken is currently under house arrest until this coming Friday.

"It's obvious to the investigators that she and Olmert are not interfering with the investigation nor are they coordinating their stories," Fettman said. "There's no need for house arrest or other limitations, with the exception of limiting conversations with Olmert."
