Danish woman who alleged rape at kibbutz now says she's 'unsure'

One of the Danish tourists allegedly raped at a kibbutz in the Dead Sea resort town of Ein Gedi has no recollection of the incident in question, according to a prosecution memo written by one of the investigators, the contents of which was revealed Wednesday by the suspects' attorneys.

Last month, two Scandinavian women tourists, aged 17 and 19, returned to the guest house where they were staying at Kibbutz Ein Gedi and said they had been raped by three residents.

The women said they had gone late at night to the room of one of the men, where they were later attacked and raped. The guest-house manager called the police who arrested the three suspects. The young men told the police they had had sex with the young women with their full consent.

At a hearing before the Be'er Sheva District Court on Wednesday, the attorneys argued there was insufficient evidence to substantiate rape charges.

Subsequently, they were made aware of the prosecutor's document in which one of the investigators in the case wrote that one of the alleged victims complained of a "blackout" after an altercation with the suspects.

The alleged victim said she was unsure of what transpired on the evening in question, despite telling police she was raped.

"She was certain that she was raped, but after the altercation she was confused as to what happened and what didn't," the prosecution report reads. "She is afraid to send someone to jail if he didn't [commit the rape], while at the time she said she was sure there was a rape. Now, she is unsure and confused."

The three Kibbutz Ein Gedi residents were indicted late last month on suspicion that they raped the tourists after it was discovered that the suspects filmed themselves assaulting one of the women.

In the film, which was taken with the suspects' cellular phones, the three suspects are seen filming one of the complainants while she is sitting in the car.

The footage shows them telling the woman to "kiss us" and when she says no they then tell her to "have sex with us". When she again refuses, the suspects are seen pulling her out of the car and throwing her down on a grassy field.
