Haifa court orders five convicted rapists to pay victim NIS 1.2 million

The Haifa District Court on Wednesday ordered five defendants, convicted of rape, to pay their victim NIS 1,200,000.

The five men were convicted of jointly raping the victim and holding her captive for three days. The amount of compensation was based on the cost of psychotherapy, and on the anguish suffered by the young woman, now 26 years old.

The defendants were convicted four years ago and were sentenced to 10 to 19 years in prison each. A sixth accomplice signed a plea agreement with the prosecution.

The court also ordered the defendants to pay the victim's attorneys fees, which amounted to NIS 125,000.

In May 2002, the woman was visiting family in a Haifa suburb. Six locals--Avi Mizrachi, 30, David Mizrachi, 38, Moshe Grottes, 31, Moti Mizrachi, 36, Gil Dahan, 38, and Zura Pelegshvili, 32--held their victim captive for three days in an abandoned house, and raped and sexually assaulted her. The six were tried and convicted in criminal proceedings.

Two years ago, the woman filed civil charges against her attackers. District Court Judge Shmuel Berliner, who awarded the woman damages Wednesday, said the compensation was decided on the basis of "the harsh injury, both emotional and physical, to the defendant, the nature of the acts and the revolting way in which they occurred."

Judge Berliner added that the victim's therapy must be considered a factor. He said it would be safe to assume that she would not receive the necessary treatment within the framework of the public health system, and that difficulty paying for therapy would only intensify her injury.
