Baby switch cost Jerusalem hospital NIS 2 million

The Jerusalem Magistrate's Court ordered Makassed Hospital in East Jerusalem to pay NIS 2 million to two sets of parents and their children who were switched at birth.

The two children were born in 1977, and in 1999, at the age of 22 years of age, DNA testing confirmed beyond reasonable doubt they were not the offspring of the parents they knew.

The two children sued the hospital for punitive damages resulting from the separation from their parents.

Makassed Hospital denied the charges, saying there was no proof that the two had been born at the hospital, or that they had been switched by a hospital employee.

The hospital also argued that the suit should be rejected under the statute of limitations.

The mother of one of the plaintiffs reported that she had been hospitalized with one other new mother when her child was born, and that the two babies had been taken at birth to be bathed before she ever saw her son.

Judge Ram Winograd rejected the hospital's claim the two infants had not been born at Makassed Hospital, and also ruled that the statute of limitatons applied because the actual distress to the children and parents began when the affair was discovered, in 1999.
